Membership Information
To become a member of the www.luccatextile.shop website, simply complete the membership form in the “My Account” section in full. Membership is free of charge and does not create any obligation to make a purchase.
It is important that your membership information is accurate, complete, and up to date so that your orders can be processed properly.
Please carefully read this Membership Agreement together with the Privacy Policy, KVKK Information Notice, Distance Sales Agreement, and other legal texts published before making a purchase.
1. Parties
This Membership Agreement (“Agreement”) is entered into electronically between:

and the natural or legal person who becomes a member of the Site (“Member”).
Hereinafter, each may be referred to individually as a “Party” and collectively as the “Parties.”
2. Subject of the Agreement
The subject of this Agreement is to determine the conditions governing the Member’s use of the www.luccatextile.shop website and to regulate the rights and obligations of the Parties.
3. Rights and Obligations of the Parties
3.1 The Member accepts that all information provided during registration is accurate, complete, and up to date.
Any legal or financial liability arising from incorrect or incomplete information belongs to the Member.
3.2 The username and password for the Member’s account shall be used only by the Member.
The Member is solely responsible for maintaining the security of the password.
3.3 The Member agrees that they will:
* comply with the laws of the Republic of Türkiye,
* not infringe the rights of third parties,
* not create fraudulent orders,
* not attempt to compromise system security,
* not upload malicious software.
3.4 The Site may not be used for:
* spam,
* viruses,
* malware,
* automated bots,
* data copying,
* unauthorized access.
3.5
Users are solely responsible for comments and content they create on the Site.
3.6
LUCCA Tekstil is not responsible for access problems arising from internet infrastructure, user devices, or third parties.
3.7
The Member agrees not to access other users’ accounts or data without authorization.
3.8
The Parties agree that, in the event of disputes, LUCCA Tekstil’s electronic records, server records, database records, and commercial books shall constitute evidence within the scope of the Turkish Code of Civil Procedure No. 6100.
3.9
The Member may not transfer the rights and obligations arising from this Agreement to third parties without the written consent of LUCCA Tekstil.
3.10
Any legal or criminal liability arising from a breach of this Agreement shall belong entirely to the Member.
Any damages suffered by LUCCA Tekstil shall be compensated by the Member.
3.11
LUCCA Tekstil reserves the right, in accordance with applicable legislation, to:
* suspend membership,
* terminate membership,
* cancel orders,
* close accounts.
3.12
The Site design,
the LUCCA TEXTILE trademark,
logo,
product photographs,
catalogs,
product descriptions,
videos,
graphics, and all content are the intellectual property of LUCCA Tekstil.
They may not be used without authorization.
3.13
For the purpose of improving Site performance, technical information such as:
* IP address,
* access time,
* device used,
* browser information,
* pages visited
may be processed.
3.14
The Member’s personal data is processed in accordance with:
Law No. 6698 on the Protection of Personal Data (KVKK),
the Privacy Policy,
the Cookie Policy,
and the applicable legislation.
3.15
The Member agrees that, if explicit consent is given, they may receive commercial electronic communications for campaigns, discounts, product promotions, and informational purposes.
The Member may change communication preferences or opt out of commercial communications at any time.
3.16
LUCCA Tekstil may share personal data with the relevant authorities where legally required or upon the request of competent public authorities.
3.17
Necessary technical measures are taken to protect the Site against viruses and malicious software.
However, users are responsible for the security of their own devices.
3.18
LUCCA Tekstil reserves the right to change, without prior notice:
the Site content,
products,
prices,
campaigns,
the membership system,
and the operating method.
3.19
This Agreement may be updated when necessary.
The updated text shall become effective as of the date it is published on the Site.
3.20
The Member agrees that they may be contacted via email, SMS, or telephone regarding order processes, membership procedures, and legal notifications.
3.21
The Member is responsible for keeping their contact information up to date.
3.22
If any provision of this Agreement is deemed invalid, the validity of the remaining provisions shall not be affected.
3.23
Failure by LUCCA Tekstil to exercise any right shall not constitute a waiver of that right.
4. Intellectual Property Rights
The intellectual and industrial property rights to the LUCCA TEXTILE trademark, logo, designs, domain name, product photographs, catalogs, software, and all content belong to LUCCA Tekstil Sanayi Ticaret Limited Şirketi.
These may not be copied, reproduced, published, modified, or used for commercial purposes without written permission.
5. Force Majeure
Earthquakes, fires, floods, wars, acts of terrorism, epidemics, strikes, lockouts, cyberattacks, power outages, internet infrastructure problems, decisions of public authorities, and other events beyond the reasonable control of the Parties shall be considered force majeure.
In such cases, LUCCA Tekstil shall not be held liable for failure to fulfill its obligations.
6. Entry into Force
By creating a membership, the Member declares that they have read, understood, and electronically accepted this Agreement in its entirety.
LUCCA Tekstil reserves the right to update this Agreement provided that such updates do not conflict with applicable legislation.
7. Termination of the Agreement
The Member may terminate their membership at any time.
LUCCA Tekstil may suspend or permanently terminate the membership if a breach of this Agreement or unlawful use is detected.
8. Resolution of Disputes
The laws of the Republic of Türkiye shall apply to disputes arising from this Agreement.
Consumer Arbitration Committees and Consumer Courts authorized under Law No. 6502 on the Protection of Consumers shall have jurisdiction.
